1. About these Terms
These Terms of Use ("Terms") apply when you access or use AdUp Australia ("AdUp", "we", "us" or "our").
By creating an account, publishing a listing, sending a message or otherwise using AdUp, you agree to these Terms.
If you do not agree to these Terms, you should not use AdUp.
2. What AdUp does
AdUp provides an online marketplace that allows users to advertise, discover and communicate about rooms and accommodation opportunities.
Unless we expressly state otherwise, AdUp does not own, manage, inspect, lease or provide the properties advertised by users.
Agreements concerning a room, inspection, tenancy, licence, rent, bond or other arrangement are generally made directly between the relevant users.
3. Eligibility and accounts
You must provide accurate information when creating and using an AdUp account.
You are responsible for keeping your login credentials secure and for activity carried out through your account.
You must not impersonate another person, create misleading accounts, or use another person's account without permission.
4. Room listings
If you publish a room listing, you are responsible for ensuring that the information you provide is accurate, current and not misleading.
This includes information about matters such as:
- the room and property;
- location;
- price and bills;
- availability;
- room type;
- occupancy arrangements;
- minimum stay;
- photos and descriptions; and
- any other material conditions.
You must have the authority to advertise the room or property.
You must update, unpublish or mark a listing as rented when it is no longer genuinely available.
5. Prohibited listings and conduct
You must not use AdUp to:
- publish false, deceptive, fraudulent or materially misleading information;
- advertise a room or property you are not authorised to offer;
- request money through deceptive, fraudulent or misleading conduct;
- harass, threaten, abuse or intimidate another user;
- discriminate unlawfully;
- upload content that infringes another person's rights;
- upload malicious code or interfere with the operation or security of AdUp;
- scrape, harvest or systematically collect information from AdUp without permission;
- use automated accounts, bots or scripts in a way that interferes with the service; or
- use AdUp for unlawful activity.
6. Messages and communication
AdUp allows users to communicate about listings through its messaging features.
You are responsible for the messages and information you send to other users.
You must not use messaging to send spam, scams, threats, harassment, unlawful material or content unrelated to the legitimate use of AdUp.
7. Personal safety and inspections
Users should exercise reasonable care when communicating with people they meet through AdUp or attending property inspections.
You should consider independently verifying important information before transferring money, providing sensitive information or entering into an accommodation arrangement.
AdUp does not guarantee the identity, background, character, conduct or reliability of users.
8. Payments, rent, bonds and agreements
Unless AdUp expressly introduces a payment service in the future, AdUp does not process rent, bonds or other payments between users.
Users are responsible for understanding and complying with any laws, rules or obligations that apply to their accommodation arrangement.
AdUp is not a party to agreements entered into directly between users unless we expressly state otherwise.
9. User content
You retain ownership of content you submit to AdUp, including listing descriptions and photographs, subject to any rights you grant us under these Terms.
By submitting content to AdUp, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format and distribute that content to the extent reasonably necessary to operate, promote and improve the AdUp service.
You represent that you have the necessary rights and permissions to submit that content.
10. Reports and moderation
Users may report listings or conduct they believe is inappropriate, misleading, fraudulent or otherwise in breach of these Terms.
We may review reports and take reasonable moderation action, including:
- requesting additional information;
- marking a report as reviewed;
- removing or unpublishing content;
- restricting account functionality;
- suspending an account; or
- taking other reasonable action to protect users or the service.
11. Suspension and termination
We may restrict, suspend or terminate access to some or all of AdUp where we reasonably believe that a user has breached these Terms, created a safety or security risk, engaged in fraudulent or unlawful activity, or misused the service.
A suspended user may be prevented from publishing new listings, starting new conversations or sending messages.
Suspension does not necessarily delete existing listings, conversations, reports or other records.
12. Third-party services
AdUp may rely on third-party services for functions such as authentication, hosting, maps, email delivery, storage, analytics and website infrastructure.
Those services may have their own terms and privacy practices.
13. Availability of AdUp
We aim to provide a reliable service, but we do not guarantee that AdUp will always be available, uninterrupted or error-free.
We may modify, suspend or discontinue features where reasonably necessary, including for maintenance, security, development or legal reasons.
14. Our role and responsibility
AdUp provides a platform through which users may connect. We do not guarantee that a listing is accurate, that a room will be available, that another user will complete a transaction or agreement, or that a user is suitable for any particular accommodation arrangement.
To the extent permitted by law, users are responsible for evaluating listings, communicating with other users and deciding whether to enter into an arrangement.
15. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.
16. Liability
To the extent permitted by law, AdUp is not responsible for loss arising solely from dealings between users, including disputes concerning listings, inspections, payments, property condition, accommodation suitability or user conduct.
Nothing in this section limits liability that cannot legally be limited or excluded.

We may update these Terms as AdUp develops or where reasonably necessary to reflect changes to the service, law or our practices.
The latest version will be published on this page with the updated date.
19. Governing law
These Terms are governed by the laws of New South Wales, Australia.
Subject to any rights that cannot legally be excluded, disputes relating to these Terms are subject to the jurisdiction of the courts of New South Wales and applicable Commonwealth courts.
